Welcome to Kingdom Sail Ltd. By accessing or using our services, including booking and participating in our sailing programs, you agree to be bound by the following Terms and Conditions. Please read these terms carefully before engaging with our services.
1. Definitions
- “Kingdom Sail Ltd”, “we”, “us”, or “our” refers to the company providing sailing programs and related services.
- “Participant” refers to anyone who registers for or participates in our sailing programs.
- “Guardian” refers to the legal guardian of a participant under 18.
- “Program” refers to any sailing camp, event, or service Kingdom Sail Ltd provides.
2. Eligibility
Participants must meet the following criteria to join our programs:
- Be aged 12-18 for youth sailing programs. Participants under 18 must have parental or legal guardian consent.
- Provide accurate and complete personal, medical, and travel information during registration.
- Agree to abide by all program rules and instructions Kingdom Sail Ltd staff provides.
3. Booking and Payment
- Deposit: A deposit of 20% of the total trip cost is required to secure your spot on our sailing camps. This deposit covers initial costs and preparations for the voyage and counts toward your final balance.
- Full Payment: The final balance is due by February 1. If payment is not received by February 15, your place will be released for other students to book.
- Cancellation Policy:
- Cancellations made before January 15: Full refund of any payments made, excluding a non-refundable application fee of $350.
Cancellations made on or after January 15: No refund will be made. We highly recommend purchasing travel insurance to suit your specific needs.
- Payment Methods: We accept credit/debit cards and bank transfers. All payments must be made in the currency specified during registration.
4. Participant Responsibilities
- Follow all safety guidelines, instructions, and program rules.
- Treat all staff, participants, and community members with respect.
- Inform Kingdom Sail Ltd of any medical conditions, allergies, or dietary requirements before the program begins.
- Maintain personal belongings. Kingdom Sail Ltd is not responsible for lost, stolen, or damaged items.
5. Health and Safety
- Medical Fitness: During registration, participants must disclose medical conditions, medications, or recent illnesses. Failure to provide accurate information may result in disqualification from the program.
- Emergency Care: In an emergency, Kingdom Sail Ltd reserves the right to seek medical assistance for participants. Any associated costs will be the responsibility of the participant or their guardian.
- Insurance: Participants are required to obtain travel and medical insurance that covers sailing activities and emergencies.
6. Program Changes and Cancellations
Kingdom Sail Ltd reserves the right to modify or cancel programs due to unforeseen circumstances, including but not limited to adverse weather, safety concerns, or insufficient enrollment.
In the unlikely event of Kingdom Sail Ltd needing to cancel a camp, participants will be offered the option of:
- A full refund, including the deposit.
- Transferring their booking to a future camp date at no additional cost.
7. Code of Conduct
- Participants are expected to maintain respectful and cooperative behavior at all times.
- Any participant engaging in disruptive, dangerous, or illegal activities may be removed from the program without a refund.
- Kingdom Sail Ltd has a zero-tolerance policy for bullying, harassment, or discrimination.
8. Liability
- Kingdom Sail Ltd will take all reasonable measures to ensure the safety and well-being of participants. However, sailing and related activities involve inherent risks.
- Participants and their guardians acknowledge and accept these risks by registering for a program.
- Kingdom Sail Ltd is not liable for any injury, illness, loss, or damage arising during or as a result of participation in our programs, except where caused by our negligence
9. Intellectual Property
- All content, materials, and branding used in Kingdom Sail Ltd programs are the intellectual property of Kingdom Sail Ltd.
- Participants may not reproduce, distribute, or use program materials for commercial purposes without prior written consent.
10. Non-Refundable Items
Any t-shirts, tops, or other shop items with the Kingdom Sail logo are non-refundable once sent to your address.
11. Privacy
Kingdom Sail Ltd collects and processes personal data under our Privacy Policy. By registering for our programs, you consent to collecting and using your data as outlined in the policy.
12. Photography and Media
- Kingdom Sail Ltd may capture photos or videos during programs for promotional purposes.
- Participants or guardians may opt out of media usage by notifying Kingdom Sail Ltd in writing before the program begins.
13. SMS Communications and 10DLC Compliance
- Opt-In Requirement: By providing your phone number, you consent to receive SMS communications from Kingdom Sail Ltd regarding program updates, payment reminders, and important notifications.
- Message Content: SMS communications may include essential updates about your registration, program logistics, emergency notifications, or promotional offers if opted in.
- Opt-Out Option: Participants can opt out of SMS communications by replying “STOP” to any message or contacting Kingdom Sail Ltd directly.
- Data Protection: All SMS communications are managed in compliance with applicable laws and regulations, including 10DLC requirements, ensuring secure transmission and protection of your data.
Third-Party Services: Kingdom Sail Ltd utilizes third-party SMS service providers that are compliant with industry standards to deliver text messages.
14. Exceptional Circumstances
We understand that life can present unforeseen circumstances. Please get in touch with us if you need to cancel due to an emergency or other significant reasons (such as illness or family emergencies). We highly recommend purchasing travel insurance to cater to unforeseen circumstances.
15. Transfer of Booking
If you cannot attend and wish to transfer your booking to another participant, you may do so up to 14 days before the camp’s start date. Please notify us in writing; we will assist with the necessary arrangements.
16. Refund Processing
Approved refunds will be processed within 14 business days of receiving your cancellation request. Refunds will be issued via the original payment method.
17. Force Majeure
Kingdom Sail Ltd is not responsible for delays, cancellations, or damages caused by events beyond our reasonable control, including natural disasters, pandemics, or government restrictions.
18. Governing Law
These Terms and Conditions are governed by the laws of the British Virgin Islands. Any disputes shall be resolved exclusively in the courts of the British Virgin Islands.
19. Changes to Terms and Conditions
Kingdom Sail Ltd reserves the right to update these Terms and Conditions anytime. Updates will be effective immediately upon posting to our website. Participants are encouraged to review these terms periodically.
